End User License Agreement (EULA)

This End User License Agreement (“Agreement”) is a legally binding agreement between you (the “User” or “Organization”) and Clear Approach Safety, LLC (“Company,” “we,” “us,” or “our”) governing access to and use of the Clear Approach Safety software platform and related services (the “Software”).

By accessing or using the Software, you agree to be bound by this Agreement. If you do not agree, you may not access or use the Software.

1. License Grant

Subject to this Agreement and the applicable Terms of Service, Clear Approach Safety, LLC grants the Organization a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Software solely for the Organization’s internal business operations.

2. Ownership and Intellectual Property

The Software and all related intellectual property rights are and shall remain the exclusive property of Clear Approach Safety, LLC. No ownership interest is transferred under this Agreement.

3. Restrictions

The Organization shall not, and shall not permit any user to:

Copy, modify, or create derivative works of the Software
Reverse engineer, decompile, or disassemble the Software
Rent, lease, sell, sublicense, assign, or transfer the Software
Use the Software for unlawful or unauthorized purposes
Circumvent security or access controls

4. User Responsibility

The Organization is responsible for all activity conducted under its account, including actions of authorized users. The Organization is responsible for maintaining appropriate internal controls over user access.

5. No Regulatory or Legal Advice

The Software is provided as a tool to assist with Safety Management System (SMS) administration. It does not constitute legal, regulatory, or compliance advice, and use of the Software does not guarantee compliance with any law or regulation.

6. Data Responsibility

The Organization retains ownership of its data. The Organization is responsible for maintaining independent backups of all data entered into the Software.

7. Term and Termination

This Agreement remains in effect for the duration of the Organization’s authorized use of the Software. Clear Approach Safety, LLC may suspend or terminate access for violation of this Agreement or the Terms of Service.

8. Disclaimer of Warranties

The Software is provided “as is” and “as available” without warranties of any kind, express or implied.

9. Limitation of Liability

To the maximum extent permitted by law, Clear Approach Safety, LLC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from use of the Software.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.

11. Entire Agreement

This Agreement, together with the Terms of Service and Privacy Policy, constitutes the entire agreement between the parties regarding use of the Software.
